सुप्रीम कोर्ट ने 15 अक्टूबर 2026 को Just Rights for Children Alliance & Anr. v. S. Harish & Ors. मामले में कहा कि इंटरनेट तक पहुँच और उसका उपयोग प्रत्येक व्यक्ति का मौलिक अधिकार है, जिसमें बच्चे भी शामिल हैं। न्यायालय ने बच्चों की ऑनलाइन सुरक्षा के लिए कई उपायों पर भी निर्देश दिए।
On 15 October 2026, the Supreme Court, in the case Just Rights for Children Alliance & Anr. v. S. Harish & Ors., held that access to and use of the internet is a fundamental right of every individual, including children. The Court also issued several directions for the online safety of children.

- अनुच्छेद 21: जीवन एवं व्यक्तिगत स्वतंत्रता का संरक्षण।
- अनुच्छेद 19(1)(a): वाक् एवं अभिव्यक्ति की स्वतंत्रता।
- न्यायालय के अनुसार, बच्चों को भी उनकी उम्र की परवाह किए बिना इंटरनेट तक पहुँच और उसके उपयोग के मौलिक अधिकार प्राप्त हैं।
- इंटरनेट शिक्षा, सूचना, संचार और अभिव्यक्ति का महत्वपूर्ण माध्यम है।
- बच्चों की सुरक्षा के नाम पर इंटरनेट तक पहुँच पर पूर्ण प्रतिबंध लगाने के बजाय हानिकारक सामग्री और शोषण को रोकने पर ध्यान दिया जाना चाहिए।
बाल सुरक्षा के लिए प्रमुख निर्देश
- राष्ट्रीय डेटाबेस: बाल यौन शोषण एवं दुर्व्यवहार संबंधी सामग्री की पहचान और उसे हटाने के लिए National Hash and URL List Database तैयार करने की दिशा में निर्देश।
- CSEAM: Child Sexual Exploitation and Abuse Material अर्थात बाल यौन शोषण एवं दुर्व्यवहार संबंधी सामग्री।
- चाइल्ड मोड: सोशल मीडिया पर बच्चों के लिए आयु-अनुकूल सुरक्षा सुविधाएँ विकसित करने पर जोर।
- प्लेटफॉर्म की जिम्मेदारी: ऑनलाइन बाल शोषण सामग्री की पहचान, रिपोर्टिंग और उसे हटाने की व्यवस्था मजबूत करना।
- डिजिटल सुरक्षा शिक्षा: बच्चों को सुरक्षित ऑनलाइन व्यवहार, सहमति, निजता और शोषण की पहचान के बारे में जागरूक करना।
- सरकारी कार्रवाई: केंद्र सरकार को संबंधित दिशानिर्देश, मानक संचालन प्रक्रियाएँ (SOPs) तथा आवश्यक कानूनी संशोधनों पर कदम उठाने के निर्देश दिए गए।
Constitutional Basis
- Article 21: Protection of life and personal liberty.
- Article 19(1)(a): Freedom of speech and expression.
- According to the Court, children also have the fundamental rights to access and use the internet, irrespective of their age.
- The internet is an important medium for education, information, communication and expression.
- Instead of imposing a complete ban on internet access in the name of child safety, the focus should be on preventing harmful content and exploitation.
Major Directions for Child Safety
- National Database: Directions towards preparing a National Hash and URL List Database for identifying and removing Child Sexual Exploitation and Abuse Material.
- CSEAM: Child Sexual Exploitation and Abuse Material.
- Child Mode: Emphasis on developing age-appropriate safety features for children on social media.
- Platform Responsibility: Strengthening mechanisms for identifying, reporting and removing online child exploitation material.
- Digital Safety Education: Creating awareness among children about safe online behaviour, consent, privacy and identification of exploitation.
- Government Action: The Central Government was directed to take steps regarding relevant guidelines, Standard Operating Procedures (SOPs) and necessary legal amendments.
